1.     WHAT INFORMATION DO WE COLLECT?

Personal information you disclose to us

In Short: We collect personal information that you provide to us.

 

We collect personal data that you provide to us directly and voluntarily when you register for one of our services, express your interest in receiving information about our products, participate in activities, and contact us.

 

Personal data provided by you. The personal data we collect depends on the nature of your interactions with us and our Services, the choices you make, and the products and features you use. This information may include, but is not limited to, the following categories:

Sensitive information. We do not process sensitive information.

 

Payment Data. We may collect data necessary to process your payments when you make purchases through our services. This includes, for example, information about your payment instrument (such as the last four digits of your credit card or its identification number) and the associated security code. For security and compliance reasons, all payment transactions are processed and secured by our Worldline providers SIX Saferpay and Stripe. Application Data. If you use our app(s), we may also collect the following information if you choose to give us access or permission to do so:

 

  • Access to mobile devices. We may ask you for access to or permission to use certain features of your mobile device, including camera, storage, and other features. If you want to change our access or permissions, you can do so in your device’s settings.
  • Data on mobile devices. We automatically collect device information (such as your mobile device ID, model, and manufacturer), operating system, system version and configuration information, device and application identification numbers, browser type and version, hardware model, Internet service provider, and/or mobile carrier,  and the IP address (or proxy server). If you use our apps, we may also collect information about the phone network associated with your mobile device, your mobile device’s operating system or platform, the type of mobile device you use, your mobile device’s unique identifier, and information about the features of our apps that you have accessed.
  • Push notifications. We may request to send you push notifications about your account or certain features of our app(s). If you wish to opt out of receiving these types of communications, you can turn them off in your device’s settings.

 

This information is primarily necessary to maintain the security and operation of our application(s), for troubleshooting, and for internal analysis and reporting purposes.

 

You warrant that all Personal Data you provide to us is true, complete, and accurate. It is your responsibility to notify us promptly of any changes to this information so that our records remain current.

In Short: Certain information – such as your Internet Protocol (IP) address and/or browser and device characteristics – is collected automatically when you visit our Services.

The information we collect includes:

 

  • Logs and Usage Data. Connection and Usage Data is service, diagnostic, usage, and performance information that our servers automatically collect when you access or use our Services and that we record in connection files. Depending on how you interact with us, this log data may include your IP address, device information, browser type, and settings, and information about your activity in the Services (such as timestamps associated with your usage, pages and files viewed, searches, and other actions you take,  such as the features you use), device event information (such as system activity, error reports (sometimes referred to as “crash dumps”), and hardware settings).
  • Device data. We collect device data, such as information about your computer, phone, tablet, or any other device you use to access the Services. Depending on the device used, this data may include information such as your IP address (or proxy server), device and application identification numbers, location, browser type, hardware model, Internet service provider and/or mobile operator, operating system, and system configuration information.

Information Collected from Other Sources

In Short: We may collect limited data from public databases, business partners, and other external sources.

 

To improve our ability to provide you with relevant marketing, offers, and services and to update our records, we may obtain information about you from other sources, such as public databases, joint marketing partners, affiliate programs, data providers, and other third parties. This information includes postal addresses, job titles, email addresses, phone numbers, intent/behavior data (or user data), access data and security data, Internet Protocol (IP) addresses, social media profiles, social media URLs, and personalized profiles, for the purposes of targeted advertising and event promotion.

 

2.     HOW DO WE PROCESS YOUR INFORMATION?

In Short: We process your information to provide, improve, and administer our services, to communicate with you, for security and fraud prevention, and to comply with the law. We process personal information for the following purposes, listed below. We may also process your information for purposes other than with your explicit prior consent.

 

We process your personal information for a variety of reasons, depending on how you interact with our services, including:

 

  • Facilitate account creation and authentication and manage user accounts. We may process your information to enable you to create and log in to your account, as well as to keep your account in good working order.
  • To provide and facilitate the provision of services to the user. We may process your information to provide you with the requested service.
  • Respond to user requests/offer support to users. We may process your information to respond to your requests and resolve any potential problems you may have with the service requested.
  • To send you administrative information. We may process your information by sending you details about our products and services, changes to our terms and policies, and other similar information.
  • To fulfill and manage your orders. We may process your information to fulfill and manage your orders, payments, returns, and exchanges made through the Services.
  • To enable communication between users. We may process your information if you choose to use one of our offerings that allow you to communicate with another user.

3.     WHAT LEGAL BASES DO WE RELY ON TO PROCESS YOUR INFORMATION?

  • Performance of a contract or pre-contractual measures. We may process your personal data when we believe it is necessary to fulfil our contractual obligations to you, including the provision of our services, or at your request prior to entering a contract with you.

We may process your information where we believe that such processing is necessary for our legitimate business interests and those interests are not overridden by your own interests, fundamental rights and freedoms. For example, we may process your personal information for the following purposes (among others): To analyze the use of our services to improve them to engage and retain our users. 4.     WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?

In Short: We may share information in specific situations described in this section and/or with the following third parties.

 

We may need to share your personal information in the following situations:

 

  • When we use the Google Maps Platform APIs. We may share your information with certain Google Maps Platform APIs (e.g., Google Maps API, Places API). We use certain APIs on the Google Maps platform to retrieve certain information when you make location-specific requests. These include travel time with different means of transport; and other similar information. A full list of the purposes for which we use information can be found in this section and in the previous section entitled ‘How do we process your information?’‘. Google Maps uses GPS, Wi-Fi, and cell towers to estimate your location. GPS has an accuracy of about 20 meters, while Wi-Fi and cell towers improve accuracy when GPS signals are weak, such as inside buildings. This data allows Google Maps to provide directions, but it’s not always perfectly accurate. We obtain and store your location on your device (‘cache’). You may revoke your consent at any time by contacting us using the contact details set out at the end of this document. The Google Maps Platform APIs we use store cookies and other information on your devices and access them. If you are a user residing in the European Economic Area (EU countries, Iceland, Liechtenstein and Norway) or the United Kingdom, please see our Cookie Notice available at https://mobilidee.ch/cookie-policy/.
  • Affiliates. We may share your information with our affiliates, in which case we will require those affiliates to comply with this Privacy Notice. Affiliates include our parent company and any subsidiaries, joint venture partners, or other companies that we control or that are under common control with us.
  • Other Users. When you share personal information (e.g., by posting comments, contributions, or other content on the Services) or otherwise interact with public areas of the Services, that personal information may be seen by all users and may be made public outside of the Services in perpetuity. Similarly, other users will be able to view descriptions of your business, communicate with you as part of our services, and view your profile.

 

 

5.     DO WE USE COOKIES AND OTHER TRACKING TECHNOLOGIES?

In Short: We may use cookies and other tracking technologies to collect and store your information.

 

We may use cookies and similar tracking technologies (such as web beacons and pixels) to collect information when you interact with our Services. Some online tracking technologies help us maintain the security of our services and your account. They help prevent crashes, fix bugs, save your preferences, and perform basic site functions.

 

We also allow third parties and service providers to use online tracking technologies on our Services for analytics and advertising purposes, including to facilitate the management and display of advertisements, to tailor advertisements to your interests, or to send abandoned cart reminders (based on your communication preferences). Third parties and service providers use their technology to provide advertisements about products and services tailored to your interests, which may appear on our services or other websites.

 

To the extent that these online tracking technologies are considered a ‘sale’/’sharing’ (which includes targeted advertising, as defined by applicable laws) under applicable state laws, you may opt-out of these online tracking technologies by submitting a request as described below in the section ‘DO US RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?’

6.     IS YOUR INFORMATION TRANSFERRED INTERNATIONALLY?

In Short: We may transfer, store, and process your information in countries other than your own.

 

Our servers are in Switzerland. Regardless of your location, please note that your information may be transferred to, stored and processed by us at our facilities and those of third parties with whom we may share your personal information (see ‘WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?’)‘ above), including facilities located in the United States, the Netherlands, and other countries.

 

If you are a resident of the European Economic Area (EEA), the United Kingdom, or Switzerland, these countries may not have data protection or other laws like those in your country. However, we will take all necessary steps to protect your personal information in accordance with this Privacy Notice and applicable law.

 

European Commission Standard Contractual Clauses:

 

We have implemented measures to protect your personal information, including by using the European Commission’s Standard Contractual Clauses for transfers of personal information between our group companies and between us and our third-party providers. These clauses require all recipients to protect all personal information they process that originates from the EEA or the UK, in accordance with European data protection laws and regulations. Our standard contractual clauses can be provided upon request. We have similar appropriate safeguards in place with our third-party service providers and partners, and further details can be provided upon request.

 

 

7.     HOW LONG DO WE KEEP YOUR INFORMATION?

In Short: We retain your information for as long as necessary to fulfill or fulfill the purposes described in this Privacy Notice , unless otherwise required by law.

 

We will only retain your personal information for as long as necessary for the purposes set out in this Privacy Notice, unless a longer retention period is required or permitted by law (including for tax, accounting, or other legal obligations). None of the purposes set out in this Privacy Notice require us to retain your personal data for longer than twelve (12) months after the termination of the user’s account.

 

When we no longer have a legitimate business need to process your personal information, we will delete or anonymize it or, if this is not possible (for example, because your personal information has been stored in backup archives), we will keep your personal information secure and isolate it from any further processing until it is possible to delete it.

 

 

8.     HOW DO WE KEEP YOUR INFORMATION SECURE?

In Short: We aim to protect your personal information through organizational and technical measures.

 

We have implemented appropriate and reasonable technical and administrative security measures, as well as organizational measures designed to protect the security of any personal information we process. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100%. Therefore, we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized persons will not be able to defeat our security and collect, access, steal, or modify your information inappropriately. While we will do our best to protect your personal information, the transmission of personal information to and from our Services is at your own risk. You should only access the Services in a secure environment.

 

9.     DO WE COLLECT INFORMATION FROM MINORS?

In Short: We do not knowingly collect data or market data to children under the age of 18 or the equivalent age as specified by law in your jurisdiction.

10. WHAT ARE YOUR PRIVACY RIGHTS?

In Short: Depending on your state of residence in the United States or your location in Europe, certain regions such as the European Economic Area (EEA), the United Kingdom, Switzerland, and Canada, provide you with rights that make it easier for you to access and control your personal information. You may review, modify or terminate your account at any time, depending on your country, province or state of residence.

 

In some regions (such as the EEA, the United Kingdom, Switzerland, and Canada), you have certain rights under applicable data protection laws. This may include the right to (i) request access to and obtain a copy of your personal information, (ii) request rectification or erasure, (iii) restrict the processing of your personal information, (iv) where applicable, benefit from data portability, and (v) not be subject to automated decision-making. If a decision with similar legal or significant effects is made solely by automated means, we will notify you, explain the main factors, and provide an easy way to request a human review. In certain circumstances, you may also have the right to object to the processing of your personal information. Withdrawal of consent: If we are relying on your consent to process your personal information, which may express and/or implied consent under applicable law, you have the right to withdraw your consent at any time. You may withdraw your consent at any time by contacting us using the contact details set out in the section ‘HOW CAN YOU CONTACT US ABOUT THIS NOTICE?’‘ below or by updating your preferences.

 

However, please note that the withdrawal of your consent will not affect the lawfulness of the processing conducted prior to such withdrawal. Similarly, this withdrawal will not affect the processing of your personal data based on legitimate processing grounds other than consent, where permitted by applicable law.

If at any time you wish to review or change the information contained in your account or terminate your account, you may do so:

  • Contact your internal mobility manager.

 

If you request that your account be closed, we will deactivate or delete your account and information from our active databases. However, we may retain certain information in our files to prevent fraud, troubleshoot problems, assist with investigations, enforce our legal requirements, and/or comply with applicable legal requirements.

 

Cookies and similar technologies: Most web browsers are set to accept cookies by default. If you prefer, you can usually choose to set your browser to delete cookies and reject them. 11. CONTROLS FOR “DO NOT TRACK” FEATURES

Most web browsers, as well as some mobile systems and applications, include a “Do Not Track” (‘DNT’) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage, no uniform technological standard for the recognition and implementation of DNT signals has been finalized. As such, we do not currently respond to browser DNT signals or any other mechanism that automatically communicates your choice not to be tracked online. If an online tracking standard is adopted and we are required to comply with it in the future, we will notify you of that practice in a revised version of this Privacy Notice.

 

California law requires us to inform you of how we respond to DNT signals from web browsers. Since there are currently no industry or legal standards that require us to recognize or honor DNT signals, we do not currently address them.

 

 

12. DO US RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?

Will your information be shared with others?

We may use your personal information for our own business purposes, such as to undertake internal research for technology development and demonstration purposes. This is not considered  to be ‘selling’ your personal information.

 

In the past twelve (12) months, we have not disclosed, sold, or shared any personal information to third parties for any business or business purpose. We will not sell or share personal information belonging to website visitors, users, and other consumers in the future.

Under certain U.S. data protection laws, you may designate an authorized agent to act on your behalf to submit a request. We may deny a request from this authorized agent if he or she does not provide proof that he or she has been validly authorized to act on your behalf in accordance with applicable laws.

 

Request for verification

Upon receipt of your request, we will need to verify your identity to ensure that you are the data subject to the information we hold in our system. We will only use the personal information provided in your request to verify your identity or authority to make the request. However, if we are unable to verify your identity from the information we already have, we may ask you to provide additional information for identity verification, security or fraud prevention purposes.

 

If you make the request through an authorized agent, we may need to collect additional information to verify your identity before processing your request. In addition, the officer will be required to provide written and signed authorization from you to submit such a request on your behalf.
